Terms and Conditions
Below are the Terms and Conditions for Union Savings Bank.


This Agreement and Disclosure provides information about the USBonline Internet Banking service and contains required federal disclosures.

For the purpose of this document, "you," and "your" shall refer to each customer who signs up for USBonline. "We," "us," or "our" shall refer to Union Savings Bank. All references to time of day in this Agreement and Disclosure refer to Eastern Time.

USBonline is an electronic banking service. You may access USBonline using a personal computer (PC) through our web page on the Internet.

A. Business Day

Our business days are Monday through Friday. Holidays are not included.

B. Services Available through USBonline

USBonline allows you to use the following home banking services:

• Transfer funds electronically between deposit accounts;
• Obtain account balances and transaction information.

USBonline also allows you to use the Bill Payment service in addition to the home banking services listed above to access your designated account(s) to pay most bills. {Bill Payment transactions are covered under a separate agreement. Please refer to the USBonline Terms & Conditions for the Bill Payment Service, for further information.}

Collectively, these are referred to as the “USBonline service.”

C. Available Funds

Available funds means the money in your account(s) which can be withdrawn or transferred together with any credit you may have available to you under your "Cash Reserve" Line of Credit Agreement. Available Funds may be less than the entire balance in your Account if, for example, we have placed a "hold" against certain funds in your account for a certain number of days to allow a reasonable time for checks deposited to or cashed against your account, to clear.

D. General Information About USBonline

You may use USBonline virtually any time, day or night, 7 days a week; however, USBonline may be temporarily unavailable due to Union Savings Bank’s record updating, or technical difficulties. In addition, access to USBonline is made available pursuant to a license agreement by and between Union Savings Bank and Fiserv Solutions, Inc. Any interruption of service or access caused by Fiserv Solutions will also prevent your use of the service. To utilize the services, you will need to enter your USBonline Password and otherwise satisfy the system's security procedures.

E. Application Process

To be eligible to use USBonline, you must complete an application which can be found on our website and choose a User ID and Password. If your application is accepted, you will be able to access USBonline pursuant to online instructions with regard to the use of USBonline. Before you use USBonline, you must read this Agreement and the online instructions. Your use of any of the USBonline services means that you agree to the terms and conditions stated in the Agreement and the online instructions.

F. Transaction Procedures

Transfers may be processed in three different transaction modes. They are as follows:

1. "Today." If you designate a transfer as a "Today" transaction, the processing date will be the next business day for transfers submitted by 10:00 am. However, sufficient funds must be available on the day and at the time you request the "Today" transaction. "Today" transfers may not be canceled for any reason once you have ended a USBonline session, as funds are immediately deducted from any designated account.

2. "Future." If you designate a Transfer as a "Future" transaction, you may request that the transaction be made on a future date that you may designate up to 364 days in advance of the processing date. The processing date will be the effective date you entered, or the next business day should the effective date fall on a weekend or a holiday. Sufficient funds must be available by midnight of the night before the processing date, but will be deducted from your designated account on the processing date. "Future" transactions may be canceled or changed until 8:00 am on the processing date.

3. "Recurring." If you designate a Bill Payment or Transfer as a "Recurring" transaction, you may request, and we will use, a processing date that re-occurs on a specified regular basis (i.e. weekly, biweekly, monthly, etc.). You must designate a "start" and "end" date. Sufficient funds must be available by midnight of the night before the processing date, but will be deducted from your designated account on the processing date. "Recurring" transactions may be canceled or changed until 12:00 midnight of the night before the processing date.

G. Transfers

1. Interbank Transfers. Transfers between your account with us and account(s) held at other financial institutions (InterBank Transfers) are accomplished through an automated clearing house (ACH) debit against the account from which funds are being transferred and an ACH credit to the account(s) to which funds are being transferred. {Interbank Transfers are covered by a separate agreement. Please refer to USBonline Terms & Conditions for InterBank Transfers & Account Aggregation for more information.}

You accept the following additional terms and conditions when you use the Funds Transfer Service (FTS) feature of the Service to transfer funds between your account(s) with us and account(s) held at other financial institutions:

a. You agree to use the FTS for legal purpose and not in violation of any laws, including but not limited to, laws and regulation designed to prevent Money Laundering or the transfer of funds to or from persons or organizations whose accounts are blocked under the regulation of the US Treasury Department.
b. You may choose to add any of the bank accounts ("FT Accounts") which you would like to use with FTS. All FT Accounts must be with financial institutions in the United States. Not all types of accounts – for example, retirement accounts -- are available for funds transfer service. You must check with your financial institution to verify its ability to participate in electronic funds transfer service.
c. A bank account may be added or deleted by you at any time.
1. To add an FT Account, you authorize FTS to access such FT Account as needed to provide this service.
2. Upon adding a bank account, you authorize FTS to make small deposits and/or withdrawals to the bank account to confirm your control of the account. The withdrawal(s) amount(s) will never be greater than the deposit(s) amount. You agree to verify online the amounts of such deposits and/or withdrawals. The bank account will be available – ‘activated’ for use with FTS service upon online verification of the amount of the deposits/withdrawals.
3. In your specific set-up there may be some FT Account authorization and activation with or without this deposit verification process.
4. Upon your request, FTS will make electronic transfers from above bank accounts via the Automated Clearing House (ACH) system in the amount you specify. You agree that such requests made with this service constitute your written authorization for such transfers.
5. Activated bank accounts are collectively called active funds transfer accounts.
6. US Federal regulations require your bank to limit the number of transactions that you authorize using your savings or money market account. Transactions funded from your savings or money market accounts will count towards this limit. You should check with your bank regarding their policy.
7. The financial institution may not investigate discrepancies between account number and names on the account. You agree that we are not responsible to investigate such discrepancies and may execute the transaction with account number reference only.
8. If any of your FT Accounts has a joint account holder, you represent and warrant that the joint account holder has consented for you to represent both and use the account with this FTS. If you do not give such consent, you should not use that account and we will terminate your use of FTS if we are notified of such situation.
d. You represent and warrant that you are owner of and have the right to access, use, and authorize us to use these FT Accounts for information and funds transfer purpose as defined in this Agreement.
e. You represent and warrant that the information you provided here is true, accurate and complete and you have the legal rights to share this with us. You are granting us the legal power of attorney to access the FT Accounts and take whatever actions are necessary, including but not limited to, transfer of funds to provide the services under this Agreement.
f. You may not be able to cancel a transaction once you ‘submit’ it. You also acknowledge that once the recipient picks up money, it is non-reversible and non-refundable.
g. A history of your past transactions is kept online. FTS does not provide any paper statement or confirmation. All the communication with you is through the online service.
h. The current balance information, if available within the service, may not be accurate due to many factors such as timing or posting difference or errors. Contact your financial institution to get most up-to-date available balance information.
i. Business days are Monday through Friday, excluding federal holidays. Saturday, Sunday and Monday are considered one business day. For the purpose of funds availability, days end at 4:00 pm Eastern Time.
j. If you close any of your FT Accounts, you are responsible for removing it from this service to avoid any transaction failure and charges related to a failed transaction. You may be charged additional fees for failed transactions.
k. No International transactions are supported with this service.
l. We are not responsible for money sent to unintended recipients because you provided or selected incorrect information.
m. All transactions will flow through your FT Accounts established with the system, and all funds in those accounts are considered available for use in the transaction service. There may be limits on transaction amount imposed by the service or financial institution.
n. Typical time to Send / Receive money using the ACH network is 3 to 5 days; however, your specific transaction time may vary from this, and we do not guarantee any specific turn around time for the FTS. You should check your accounts to see debiting or crediting of the amounts to confirm the status of funds.
o. There may be limitations related to each transaction, such as total amount, number of transactions allowed, or total transaction amounts. They are typically defined by your financial institution and are displayed within the service overview.
p. You agree to you may have to pay transaction fees associated with this service. Such fees are typically defined by your financial institution and are displayed with the service overview. Fees associated with each transfer are non-refundable. We may process a transaction against your account without notice to you. Any failed transaction due to insufficient funds or rejection or reversal of transaction by your FT Accounts institution may be subject to a charge.
q. If you notice any error in your accounts related to the Funds Transfer Service, you must contact the financial institution and us promptly via phone. If no phone contact is available, you may notify us online using the Service.
r. You further agree that we shall not be liable for any losses, costs, fees, or damages of any kind incurred by you as a result of your use of the Funds Transfer Service, our access to your accounts, our debiting or crediting your accounts, our inability to debit or credit your accounts or any inaccuracy, misinformation, charges or fees applied by the account-holding institution or third parties, or any limitations related to funds transfer transactions. We have the right to terminate your use of the service, reject, reverse, or cancel any transactions you initiate, and/or restrict or condition your ability to transact at any time and for any reason, including but not limited to:

1. insufficient funds in your account

2. your sharing or disclosing your password with anyone

3. suspicious activity

4. order of any law enforcement agency

5. our inability to verify information you provided

6. your providing us with false or inaccurate information

7. hacking, tampering, or impacting the service functionality, availability or security

8. using the service for unlawful purpose, or

9. failing to cooperate with any information request or to remit service fees that are due and owed to us.

s. If your account ever reflects an amount owed to us, you agree to pay such amount to us immediately upon demand. You also agree to pay for all collection costs including reasonable attorney’s fees and costs. For funds transfer transactions, we debit one of FT Accounts and credit another of the FT Accounts. If the debit transaction fails and the credit transaction has been completed, you authorize us to collect from the FT Account to which the credit was sent. We reserve the right to resubmit a debit, or partial debit against any of your FT Accounts to recover any deficiency resulting from the original amount plus any fees imposed.
t. You understand that these terms and conditions of use of FTS are additive to overall Service terms and conditions.

2. IntraBank Transfers are transfers you make between your accounts with us.
a. Account Designation. All accounts with us, which you may designate to transfer funds electronically through USBonline, must be in your name.
b. Funds Availability. Although you receive immediate provisional credit upon completion of your USBonline session for "Today" IntraBank transfers made during the session, you must make transfers before 10:00 a.m. on a business day for those funds to be posted on an account that day and to be available for non-USBonline transactions. Transfers designated as "Today" transactions made after 10:00 a.m., or on a weekend or holiday, will be available for the payment of non-USBonline transactions on the following business day. "Today" transfers cannot be canceled.
c. Transfers designated as "Future" or "Recurring" transactions will be processed by 8:00 a.m. of the processing date. If the processing date falls on a weekend or holiday, the transfer will occur on the next business day. Future dated transfers may be changed or canceled until 12:00 midnight of the night before the processing date.

G. Limitations on Services

1. Dollar Limitations. There is a dollar limit of $9,999,999.99 or the available balance in your designated funding account, plus your Cash Reserve Line Of Credit available balance if applicable, whichever is less, on any one payment, IntraBank transfer, or InterBank transfer.

2. Transfer Limitations. Except as provided herein, all Transfers to and from an account are subject to the terms and conditions applicable to such account as set forth in the account agreement governing such account. Your ability to transfer funds from your statement savings and money markets is limited by federal law as stated in your Deposit Account Agreement. By law there may be a maximum number of transfers from these accounts per monthly statement cycle initiated on your computer (or by means of telephone, wire or preauthorized transfers).

3. Available Funds Required. All Transfers initiated through USBonline are subject to there being sufficient funds available in the affected account including, if applicable, your Cash Reserve Line of Credit, to cover the transfer on the processing date or earlier.

4. There may be a one (1) business day delay in transferring funds between designated accounts depending upon the day and time on which you request the transfer.

5. E-mail you send us will not be immediately received by us. See paragraph N if you need to contact us immediately (for example, to report an unauthorized transaction from an account). No action will be made on your E-mail request until we actually receive your message and have a reasonable opportunity to act. You cannot use E-mail to transfer funds between accounts or to conduct transactions. You must follow the instructions for USBonline internet banking to accomplish these activities. E-mail transmissions through general or public E-mail are not secure. We therefore request that you do not send to us or ask for sensitive information such as account numbers, or Passwords, through any general or public E-mail system.

H. Stopping or Modifying USBonline Authorized Payments

Payments designated as "Today" transactions cannot be stopped, canceled, or changed once your USBonline session is terminated. Except as stated below, in order to request a stop payment or change to a USBonline transaction designated as "Future" or "Recurring," you must use USBonline and follow the instructions provided to you. You must cancel the payment or transfer using USBonline by 12:00 midnight of the day before the scheduled processing day.

You understand we will accept a verbal or written notice to stop a USBonline transaction if it relates to a payment designated as "Recurring" and only if the notice is received at USBonline Customer Service, (at the address and phone number listed in paragraph P of this Agreement and Disclosure) no later than three business days before the scheduled date of the payment or transfer. If you call, we may also require you to put your request in writing and get it to us before the scheduled date of the payment or transfer or within fourteen days after you call, whichever is earlier. The notice must specify whether the cancellation applies to only one of the recurring transactions, or to all transactions in the recurring stream. You understand that your written notice will be accepted only at the address and phone number listed in Paragraph P of this Agreement and Disclosure.

If you request a cancellation of a transaction as set forth above and we do not do so, we will be liable for the damages caused as explained in paragraph S.

I. Authorization To Charge Accounts

You authorize us to charge your account for the amounts of any transactions performed through the use of USBonline, including the amount of any Transfer that you make. You authorize us to transfer funds according to the instructions we receive if the instructions are received from you through USBonline. You authorize us to debit your accounts at the Bank or elsewhere, in order to correct any mistaken credit entry. You understand that if a Transfer request describes the beneficiary inconsistently by name and account number, execution of the request will occur on the basis of the account number, even if the account belongs to a person different from the named beneficiary. Further, we and other financial institutions to which a Transfer request is forwarded may rely on any identification number supplied by you as a means to identify any bank, even if the identification number is not correct for the bank named by you. Your obligation to pay the amount of the Transfer is not excused in such circumstances.

J. Account Information; Electronic Notice

You may check the balance(s) of your accounts that are accessible through USBonline. (Note: the balance figure may not reflect recent transactions and may include funds which are not subject to immediate withdrawal.) You may get a listing of transactions posted to your primary checking account since your last monthly statement and may get general account information for all accounts accessible through USBonline.

K. Service Fees

Your account may be subject to a monthly service fee.

L. Security Procedures

When you enroll in USBonline, you understand that you will define a new, permanent USBonline Password. The USBonline User ID and Password are confidential and should not be disclosed to third parties. You are responsible for the safekeeping of your User ID and Password. You agree not to disclose or otherwise make your User ID and Password available to anyone.

M. Liability for Unauthorized Use

This section applies to consumer accounts only. For information regarding business accounts, please refer to our Business Electronic Funds Transfer and Debit Card Agreement.

You will notify us immediately if you believe that your USBonline User ID and/or Password has become known to an unauthorized person. Telephoning us AT ONCE at the number listed in paragraph P is the best way of keeping your possible losses to a minimum. If you suggest that an unauthorized transfer or payment may have occurred, we may require you to sign an affidavit.

You could lose all the money in your deposit account(s) accessed through USBonline (plus your maximum overdraft line of credit, if any) if you don't inform us that your USBonline Password has become known to an unauthorized person. If you tell us within two business days after it is known to you, you can lose no more than $50.00 if an unauthorized person used your USBonline Password to access USBonline without your permission.

If you do not tell us within two business days after you have learned that your USBonline Password has become known to an unauthorized person and we can prove that we could have stopped someone from using your USBonline Password without your permission if you had told us, you could be liable for as much as $500.00.

Also, if your statement shows electronic funds transfers that you did not make, you will notify us immediately. We may require you to provide your complaint in the form of an affidavit. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time.

If a good reason (such as a long trip or a hospital stay) keeps you from telling us, we may extend the time periods.

N. Notification Of Unauthorized Transaction

If you believe your USBonline Password has become known by an unauthorized person, or that someone has transferred money without your permission, you must call USBonline at 866-719-ONLINE (866-719-6654).

O. Liability For Failure To Make Payments

If we do not make a transfer on time, or in the correct amount according to your instructions given in accordance with this Agreement and Disclosure, we will be liable for certain types of losses or damages caused; however, there are some exceptions. We will not be liable, for instance, if:

1. through no fault of ours, your designated funding account does not contain sufficient funds to make the payment or transfer;
2. the transfer would go over the credit limit on your Cash Reserve Line of Credit;
3. the equipment, phone lines, or computer systems were not working properly or were temporarily unavailable;
4. circumstances beyond our scope of control, such as fire or flood, prevented the payment or transfer, despite reasonable precautions that we have taken;
5. a court order or legal process prevents us from making a transfer or payment;
6. we have a reasonable basis for believing that unauthorized use of your User ID, Password or designated account(s) has occurred or may be occurring or if you default under any agreement with us or if we or you terminate this Agreement; or if you have not given us complete, correct and current instructions so that we can make a transfer.
If any of the circumstances listed in subparagraph 3. or 4. occurs, we shall assist you with reasonable efforts in taking appropriate corrective action to reprocess the transactions that may not have been completed or to correct transactions that have incorrectly been processed.

P. Errors or Questions

You will telephone us at (866) 719-ONLINE (719-6654) or write Union Savings Bank, Electronic Banking Department, P.O. Box 647, Danbury, CT 06813-0647, as soon as you can, if you think your statement is wrong or if you need more information about a Transfer listed on the statement. We must hear from you no later than 60 days after we mailed the statement on which the problem or error appeared. A statement is considered to have been mailed when it is first made available. You must:

1.Tell us your name and account number.
2.Describe the error you are unsure about, and explain as clearly as you can why you believe it is an error or why you need information.
3.Tell us the dollar amount of the suspected error.

If you tell us verbally, we may require that you send your complaint or question in writing within ten (10) business days. We may require you to provide your complaint in the form of an affidavit.

We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. (We may extend this time period to 20 business days if the error occurred within 30 days of the first deposit to your Account). If we need more time, however, we may take up to 45 days to investigate your complaint or question. (If the complaint or question concerned a transaction that occurred within 30 days of the first transaction to your Account, we may take up to 90 days to complete our investigation). If we decide to do this, we will credit your deposit Account within ten (10) business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not re-credit your deposit Account.

We will tell you the results within three (3) business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
Other Problems If you believe an error other than an electronic funds transfer problem has occurred concerning a deposit account, or if you have a problem regarding a credit account accessed by an ATM Card, you must refer to your monthly statement for instructions regarding how to have us resolve your question or correct an error.

Q. Account Information Disclosure

We will disclose information to third parties about your account and the payments or transfers you make:

1.when it is necessary order to verify the existence and the condition of your account for a third party, such as a credit bureau or merchant; order to comply with government agency or court orders; any subsidiary or affiliate;
5.if you give us your written permission; otherwise permitted in Union Savings Bank's Deposit Agreement and Disclosures, by law, or as required by government regulations;
7.we have entered into an agreement to have another party assist us in providing Union Savings Bank online banking services; in order to carry out your instructions, we will provide this party with, or it will receive from you, information about your designated Account(s), your USBonline banking services transactions, and your electronic mail messages; collect any debt that you may owe to us; or
9.we may collect customer account data with the purpose of learning about aggregate customer usage patterns, customer telephone inquiries, and the effectiveness of USBonline banking services, but shall not disclose individual identifiable information, except as provided in this paragraph.

R. Documentation And Verification Of Payments And Transfers

1. Confirmation Numbers
Upon completion of a transaction using USBonline, a confirmation number will be given. You should record this number, along with the payee, scheduled date, and transaction amount in your checkbook register (or other permanent record), because this will help in resolving any problems that may occur. No printed receipts are issued through USBonline.

2. Periodic Statements
Information concerning USBonline transactions will be shown on your normal statement for the account to and from which transfers are made. You will get a statement monthly, unless there are no electronic funds transfers in a particular month. In any case, if your account is a checking, savings, or money market, you will get a statement at least quarterly.

3. Recurring Deposits
If you have arranged to have deposits made to a deposit account at least once every 60 days from the same person or company, you can find out whether or not the deposit has been made through USBonline. Or, you can call Union Savings Bank Customer Service at (203) 796-1970 or toll-free (877) 235-4446 to find out whether or not the deposit has been made.

S. Other Conditions

You are responsible for complying with all terms of this Agreement and Disclosure and the regulations governing the deposit accounts which you access using USBonline. We can terminate your USBonline privileges without notice to you if you do not comply with this agreement. The regulations governing your deposit account are set forth in our Deposit Account Agreement, a copy of which is available from any branch location or from Customer Service.

This Agreement and your ability to use any or all of USBonline services may be terminated at any time by us or you upon giving written notice of the termination to the other party. If you terminate USBonline service, you authorize us to continue making transfers and bill payments you have previously authorized until such time as we have had a reasonable opportunity to act upon your termination notice. Once the Bank has acted upon your termination notice, you will make no further transfers or payments from your Accounts, including any transfer or payments you previously authorized. If we terminate your use of USBonline, we reserve the right to make no further transfers or payments from your Accounts, including any transactions you have previously authorized.

T. Change In Terms

We will mail or deliver a written notice to you at least 21 days before the effective date of any change in a term or condition disclosed in this Agreement and Disclosure, if the change would result in service fees or charges, increased liability for you, fewer types of available electronic fund transfers, or stricter limitations on the frequency or dollar amounts of transfers, unless prior notice is excused by law.

U. Privacy Policy
USBonline customers will be authorized to enter a secure area of our site to conduct on-line transactions. Information about your transactions may be shared with other parties as necessary to allow us to process your transactions. We do not disclose any non-public information about our customers or former customers to anyone, except as permitted by law. {Please refer to Our Customer’s Right to Privacy for more information.}

V. Assignment
We may assign your rights and delegate your duties under this Agreement to any other party.

W. Severability

If any provision of this Agreement is held invalid, illegal, void or unenforceable by any rule or law, administrative order or judicial decision, all other provisions of the Agreement shall remain in full force.

X. Governing Law

This Agreement is governed by and shall be construed in accordance with the laws of the State of Connecticut and applicable federal law.
